INTERNATIONAL FOUNDER GUIDE

Can a non-resident set up a company in the UAE?

Yes, many UAE Free Zone and Mainland routes are available to international shareholders. Company ownership, residence visas and corporate banking are related—but separate—decisions.

THE SHORT ANSWER

You do not always need UAE residency to own a company.

Many formation authorities accept non-resident shareholders and allow 100% foreign ownership. The selected activity, management arrangements and authority requirements determine the practical process.

However, owning a licence does not automatically provide residence rights or guarantee a UAE business bank account.

THREE SEPARATE QUESTIONS

Ownership, residency and banking should not be confused.

Company ownership

An international founder can often own shares in a UAE company without first holding a UAE residence visa.

UAE residency

An eligible company can support a later investor, partner or employment visa route, subject to establishment, immigration and applicant requirements.

Corporate banking

Banks independently assess the owners, business, transactions, source of funds, countries involved and commercial substance.

REMOTE FORMATION

Can the company be formed without travelling?

Some formation routes allow much of the company application to be completed remotely. Requirements vary, and signatures, identity checks, residency steps or banking may require physical presence.

If residency is planned, medical screening and biometrics take place in the UAE. Bank onboarding arrangements depend on the institution and applicant.

WHAT TO PLAN

Prepare the cross-border picture.

✓ Business activities and customer markets

✓ Shareholder nationality and country of residence

✓ Expected UAE presence and visa needs

✓ Source of investment funds

✓ Expected incoming and outgoing transactions

✓ Tax residence and obligations outside the UAE

IMPORTANT BOUNDARY

A UAE company does not erase obligations elsewhere.

Management location, personal residence, permanent-establishment rules and cross-border income can create consequences outside the UAE. Obtain qualified advice in every relevant jurisdiction before relying on a structure for tax treatment.
